Harrison Declan PLLC has officially filed a lawsuit in the Federal District Court in San Antonio under the Administrative Procedure Act (“APA”). This legal action challenges the U.S. Attorney General’s recent decision to deport a client to Cameroon—a country where she is neither a citizen nor a national.

The Legal Basis: Challenging “Arbitrary and Capricious” Decisions

Under 8 U.S.C. 1231, the Attorney General holds the discretion to remove a noncitizen to a third country, provided their life or freedom would not be threatened there.

However, the law requires that these decisions be based on evidence. In this case, our client faces certain persecution if removed to Cameroon. We believe the government’s claim that her safety is not at risk is fundamentally arbitrary and capricious—a direct violation of the standards set by the APA.
